Spyder Insyder loyalty programme - Terms and conditions of use

With a view to offering an enriched shopping experience, the Spyder Europe brand, operating under the company Liberated Brands Europe, a simplified company with share capital of €50,000, whose registered office is located at 1, allée Belharra in Anglet (64600), France, registered in the Bayonne Trade and Companies Register under number 898 331 202 ("Spyder"), offers its customers a loyalty programme, the terms of which are set out below.

As the use and benefits of the Programme are subject to and governed by these General Terms and Conditions of Use ("GTCU"), Spyder advises you to read them carefully.

At any time and without prior notice, Spyder reserves the right, at its sole and absolute discretion, to amend or update these GTCU, even if the changes may affect the value of Points (as defined below) already accumulated. The updated version of the GTCU will be available at the bottom of the Spyder website under the "T&C Loyalty Programme" tab and via the following link: https://eu.spyder.com/pages/loyalty-terms-conditions.

It is therefore your responsibility to take note of these changes, which will apply to any subsequent use of the Programme. Use of your Spyder account after each update of the GTCU will constitute acceptance of these changes.

These GTCU are effective on 19/04/2024.

  1. Purpose of the Programme

The Spyder Insyder loyalty programme ("Programme") applies only to items sold on the www.eu.spyder.com website, accessible in Europe in the countries where Spyder items are delivered, ("Eligible Items") or to the performance of an activity defined by Spyder, such as following Spyder on social networks ("Eligible Activity").

  1. Conditions of eligibility for the Programme

To enjoy the benefits of the Programme, you must either have an active Spyder account on www.eu.spyder.com or go to www.eu.spyder.com to create and activate a Spyder account ("Membership") before purchasing Eligible Items or performing an Eligible Activity.

Membership is open to any person aged at least fifteen (15) who resides in Europe in one of the countries where Spyder products are delivered.

The Programme is for the personal use of individuals only and is limited to one (1) account per person. Spyder employees, pro-forma customers and individuals using unpublished corporate discounts are not eligible to participate in the Programme.

  1. Joining the Programme

Membership of the Programme is free.

It is conditional on acceptance of these GTCU, the privacy policy and which are accessible after adhering to the Programme.

To do this, you need to create an account by:

  • indicating your full name;
  • confirming that you are at least 15 years old;
  • indicating your e-mail address; and
  • creating your password.

  1. How the Programme works

4.1. Points accumulation

The purchase of an eligible item and/or the completion of an eligible activity will enable you to accumulate Programme points ("Points") which will give you access to the loyalty benefits set out below.

The number of Points you can earn is determined by Spyder and depends on the price of the eligible Item(s) after applying any discounts to your purchase on www.eu.spyder.com, excluding taxes, shipping and handling.

Promotional announcements will indicate the number of Points you can earn by completing an eligible Activity.

Spyder reserves the right to make the final decision as to whether a purchase or the completion of an eligible Activity gives entitlement to Points.

Programme members earn Points according to their loyalty status at the time of each purchase:

  • As part of BRONZE membership, earn five (5) Points for every €1 = £1 = CHF1 spent on one or more eligible Items purchased from www.eu.spyder.com.
  • As part of SILVER membership, earn seven (7) Points for every €1 = £1 = CHF1 spent on one or more eligible Items purchased from www.eu.spyder.com.
  • As part of the GOLD membership, earn ten (10) Points for every €1 = £1 = CHF1 spent on one or more Eligible Items purchased from www.eu.spyder.com.

To earn Points, you must be connected to your Spyder account when you purchase eligible Items on the www.eu.spyder.com website and/or when you carry out an eligible Activity.

Spyder will credit Points earned to your account within thirty (30) days of the purchase of an eligible Item or the completion of an eligible Activity. Points can only be used once they have been credited to your account.

Points will be deducted from purchases of an eligible Item if it is returned, refunded, credit adjusted, , or made by or for a business.

  • Points will not be awarded for purchases made before the Programme was launched or before you joined the Programme.
  • No Points will be earned on eligible Item(s) purchased with Points.
  • No Points will be awarded for eligible Items purchased by Spyder employees, pro-forma customers and customers using unpublished promotions.
  • The purchase of a Spyder gift card does not give entitlement to any Points.
  • No Points will be awarded on eligible Items purchased with a Spyder gift card as the only method of payment.

Points accumulated from the purchase of one or more Eligible Items that you return for a refund will be deducted from your overall Points balance.

Taxes, shipping, and handling charges and any charges other than the purchase price of the eligible item are not included in the calculation of Points. Shipping and handling charges apply to all items, including those purchased with Points.

 

4.2 Registered nature of Points

Points are nominative and non-transferable. They may not be combined with Points from other members of the Programme, nor may they be transferred by any means whatsoever to any other person, including as part of the estate of a deceased member. Points accumulated do not constitute the property of the member.

4.3. Terms of use and validity of Points

Points can be:

  • redeemed for a one-time discount code ("Reward") on future purchases of Spyder products at eu.spyder.com, or

 

  • used to purchase certain Spyder items or experiences offered from time to time by Spyder in exchange for Points.

Points have no monetary value and cannot be converted or exchanged, directly or indirectly, for money.

To redeem Points for a Reward, your Membership must be active. When redeeming Points, they will be deducted from your account immediately after an order has been validated on www.eu.spyder.com or when you redeem Points for a Reward to be used in a Spyder shop.

For purchases made on www.eu.spyder.com, the Points available may give entitlement to a Reward during the checkout process.

In any case, you must be logged in to your Spyder customer account to apply your available Points to your current order.

Points must be exchanged in increments of :

  • 1,000 Points for a Reward equivalent to 15 euros;
  • 2,000 Points for a Reward equivalent to 30 euros;
  • 3,000 Points for a Reward equivalent to 45 euros; or
  • 4,000 Points for a Reward equivalent to 60 euros.

Only one (1) Reward may be awarded per purchase. Rewards cannot be combined with other vouchers or promotional codes (€99 minimum purchase to use loyalty vouchers).

Points expire twelve (12) months from the date of your last purchase of a qualifying item, your last qualifying activity or your last redemption of Points. Each time you purchase a Qualifying Item, perform a Qualifying Activity or redeem Points, the expiry date of any unused Points will be extended by a further twelve (12) months.

4.4. Return of eligible Items

Returns of eligible Items purchased with a Reward or in combination with another payment method must comply with the following terms and conditions:

  • Returns must be sent to the original point of purchase.
  • When the entire order is returned, the order will be reimbursed using the original method of payment. Points exchanged for a Reward will be credited back to the member's account within thirty (30) days of the return date.
  • A partial return of a purchase involving several items will be reimbursed according to the original method of payment, but the Reward will still be used, and no Points will be credited back to the member's account.
  • Items may be returned within thirty (30) days of purchase and are free of charge for members of this Programme (BRONZE, SILVER and GOLD). To benefit from free returns, it is sufficient to have BRONZE status at the time of your online order.

4.5. Benefits granted depending on Status

To the extent permitted by law and depending on your BRONZE, SILVER or GOLD loyalty status ("Status"), Spyder reserves the right to offer you Rewards and promotional offers based on your purchases, geographical location or information provided by you.

Your eligibility to obtain Statuses under the Programme is based on your cumulative purchases of Eligible Items made on the www.eu.spyder.com website over a twelve (12) month period, as defined below.

Your eligibility to move up in the Programme will be regularly updated and is calculated as follows:

Net purchases = Total purchases of eligible items - Returns of eligible items over the previous twelve (12) months.

Access to BRONZE, SILVER and GOLD status is subject to the following conditions and gives you access to the following benefits:

BRONZE STATUS

The total of your Net Purchases of Eligible Items is less than £/CHF/€649 over a period of twelve (12) months from the date of obtaining BRONZE Status.

BRONZE Status members enjoy the following benefits:

  • Welcome offer of 300 points
  • Free returns on all orders
  • €15 discount on your second purchase of €99 or more as a Programme member on your first order of €99 or more
  • €30 discount on your third purchase of €199 or more as a Programme member on your second order of €99 or more
  • Double Points Days: Earn double Points for €1 spent on eligible purchases during specific Reward periods that take place on specific days throughout the year.
  • 15% discount on your first order as part of the Spyder rental programme (https://rent.spyder.com/)

SILVER STATUS

The total amount of your Net Purchases of Eligible Items is between £/CHF/€650 and £/CHF/€999 over a period of twelve (12) months from the date on which you obtained SILVER Status.

In addition to the benefits of BRONZE Status, SILVER Status members also enjoy the following advantages:

  • Free standard delivery on all orders with no minimum.

GOLD STATUS

The total amount of your Net Purchases of Eligible Items exceeds £/CHF/€1,000 over a period of twelve (12) months from the date on which you obtained GOLD Status.

In addition to the benefits of BRONZE and SILVER status, GOLD members also enjoy the following advantages:

  • Access to exclusive discounts and promotional offers
  • A €30 birthday gift for a minimum order of €100 (valid for 3 months).

Moving up to a higher Status entitles you to the benefits applicable to that Status as well as all the benefits associated with the previous Status(es).

Your Status is valid for twelve (12) months from the date on which you obtained this Status, unless you make additional purchases of Eligible Items which enable you to move up to the next Status. To maintain your Status, your total Net Purchases of Eligible Items during the twelve (12) months from the date you obtained your Status must be equal to the required minimum total Net Purchases of Eligible Items for that Status.

 

  1. Communications

As part of the Programme, Spyder may, at its discretion, send you printed/electronic Points statements, Programme updates, and other related materials.

Spyder reserves the right to cease providing you with updates to the Programme and related documents.

  1. Information and complaints

You can check your account activity online at www.eu.spyder.com.

  1. Cancellation and account closure

You may cancel your membership at any time by notifying Spyder Customer Services by post, e-mail or telephone using the following contact details:

Spyder reserves the right to close your account at any time if there is no activity for a period of three (3) years , which will result in the loss of all Points accumulated. For the purposes of these terms and conditions, "account activity" means any purchase or redemption of Points. Spyder reasonably determines in its sole and absolute discretion whether an account is inactive.

Spyder may terminate the Programme and/or your Membership at any time at its sole discretion without entitlement to compensation. In the absence of cause, you will have at least ninety (90) days to redeem the Points you have earned prior to the termination of your Membership or at the end of the Programme.

Failure to comply with these terms and conditions, engaging in fraudulent or illegal activities, purchasing items with the intent to resell, "hacking", distorting or falsifying any data provided to Spyder, engaging in any activity that is detrimental or contrary to the interest of Spyder or other Spyder account holders, or any other inappropriate conduct may result in the immediate and automatic cancellation of your Membership and your future disqualification from the Programme or other Spyder promotional programmes, the forfeiture and cancellation of all accrued and unused Points and the termination of the business relationship with Spyder, without the member being entitled to claim any compensation whatsoever.

In enforcing the terms and conditions governing the Programme, Spyder reserves the right to take appropriate legal action, if it deems it necessary, and to recover damages, legal fees and court costs.

All Spyder decisions are final and conclusive in each case.

  1. Privacy and personal data

The information you provide will be processed in accordance with Spyder's privacy policy. By joining the Programme, you consent to your data being processed by Spyder in accordance with this privacy policy.

You have the right to consult, modify or delete the personal data you have provided as part of the Programme by contacting the dedicated service (eu.service@spyder.com).

No personal data will be collected from persons whom Spyder knows to be under fifteen (15) years of age.

Spyder reserves the right to check the accuracy of the information you have provided as part of the Programme at any time.

  1. Liability

Spyder may not be held liable for the consequences of malfunctions or anomalies affecting the operation of the Programme, whatever their cause or origin.

Under no circumstances will Spyder be liable for acts committed by members in breach of these terms and conditions.

You are solely responsible for the security and non-disclosure of your access identifiers and passwords to your Spyder account.

The fact that Spyder does not avail itself of a breach of these conditions does not constitute a waiver of any of its rights.

Taxes may apply where required by law. You are responsible for all taxes you may incur in receiving and/or redeeming Points.

  1. Survival of general conditions

If one or more of the provisions of these general terms and conditions should be invalidated or annulled, the other provisions shall retain their full force and scope.

  1. Applicable law and dispute resolution

These GTCU are governed by French law. Only the French version of these terms and conditions shall be binding.

Any dispute arising from their interpretation or execution should be the subject of an attempt at amicable resolution by you.

If you fail to find an amicable solution within two (2) months, you may refer the matter to the relevant French courts.
